In this edition of HomeGames, we turn our attention to the topic of regulation.

The panellists were:

- Philippa Hann, managing director, Clarke Willmott

- Dennis Hall, managing director, Yellowtail Financial Planning

- Michael Ruck, partner, K&L Gates

- and our own in-house regulatory expert Mike Barrett, consulting director, the lang cat

We began with a reminder of what the FCA’s objectives actually are – consumer protection, enhancing market integrity and promoting competition – and whether the regulator is delivering on any or all of these fronts.

The panel then moved on to discuss their frustrations around the FCA and where the regulatory system is going wrong  – from British Steel to the dynamic between Financial Services Compensation Scheme levies and professional indemnity insurance.

They talked about the change the FCA has and hasn’t gone through, the culture at the regulator (amid headlines about strikes and poor toilet behaviour) and whether the regulator is looking after the right people.

There was also an inevitable conversation about the Consumer Duty rules, and what needs to happen next for both advisers and providers, as well as the step change that’s needed in the way the FCA communicates.
